Licensing Under a Byproduct-Material Framework

The breeder pursues licensing through a byproduct-material framework suited to a device that produces isotopes and neutrons rather than grid power.

Matching the framework to the machine

Regulatory frameworks were built for the machines regulators knew. A fusion breeder that produces isotopes and neutrons, and handles tritium, fits more naturally under a byproduct-material framework than under a large fission-reactor licensing regime. The program pursues licensing on that basis.

Why byproduct-material fits

The hazards to be regulated are radioactive material handling, neutron activation, and tritium accountancy, precisely the domain of byproduct-material regulation. The machine does not present the accident spectrum of a fission core, and its product is material, which aligns the regulatory question with how the facility actually behaves.

Pre-application engagement

Rather than arriving with a finished application, the program engages regulators early through pre-application discussion, so the licensing basis is agreed as the design matures. This reduces the risk of late redesign and gives the regulator visibility into a machine type that is new to them.

Honest status

The licensing pathway is in engagement, not approval. It is a precondition being worked in parallel with the Q2 2027 construction start, and counsel review governs formal submissions. The framework choice is described here as the intended pathway for a machine not yet built or licensed.
